The City Council of the City of Kirksville, Missouri, met in a Special Session on Monday, February 13, 2006, at 5:00 p.m. in the City Hall Council Chambers.

 

INFORMATION PRESENTATIONS

 

OFFICIAL PROCLAMATION

WHEREAS, the Kirksville R-III Tigers boy’s basketball team has claimed the North Central Missouri Conference championship; and

 

WHEREAS, the Kirksville R-III Tigers boy’s basketball team officially wrapped up the NCMC with Moberly on February 7, 2006, with a victory score of 50-34; and

 

WHEREAS, the Kirksville R-III Tigers boy’s basketball team is celebrating its first NCMC Championship since 1973.

 

NOW, THEREFORE, I,  Martha Rowe, Mayor of the City of Kirksville, Missouri, do hereby proclaim an opportunity for all Kirksville citizens to recognize and express their pride and appreciation for the hard work, dedication and supreme achievements to the Kirksville R-III Tigers boy’s basketball team:

Mayor Rowe presented a framed proclamation, and city lapel pins to members of the Kirksville R-III Tigers boy’s basketball team who recently claimed the North Central Missouri Conference championship.

 

 

ACTION PRESENTATIONS

BILL NO. 2006-06                                                                                                                            

 

AN ORDINANCE REZONING REAL ESTATE DESCRIBED HEREIN FROM DISTRICT R-3, MULTI-FAMILY RESIDENTIAL, TO DISTRICT C-1P, LOCAL BUSINESS PLANNED, AND CHANGING THE ZONING DISTRICT MAP ACCORDINGLY.

 

Mayor Pro Tem Crist moved to adopt Bill No. 2006-06 on first reading; seconded by Councilmember Newton.

 

Code Administrator Paul Frazier reported that Steve and Taira Byrn are requesting rezoning of the 700 block of North Centennial for use of the old Willard School for child and adult daycare.  The building’s upstairs will be used for retail and business use.  No alcohol will be used on the premises.

 

The motion carried by the following vote:  Mayor Rowe, aye; Mayor Pro Tem Crist, aye; Councilmember Cupelli, aye; Councilmember Newton, aye.  Nays, none.

 

Airport Improvements Agreement

Councilmember Cupelli moved to authorize the City Manager to enter into an agreement with W.L. Miller Company for airport improvements in the amount of $301,407.75; seconded by Mayor Pro Tem Crist.

 

Public Works Director John Buckwalter reported the project will consist of relocating Stuckey Cemetery Road, extending the main terminal apron, grading and drainage improvements in the safety zones and earth work on an area designated for future hangar construction.  The project is eligible for 95% reimbursement from the Department of Transportation Aviation program.

 

The motion carried by the following vote:  Mayor Rowe, aye; Mayor Pro Tem Crist, aye; Councilmember Cupelli, aye; Councilmember Newton, aye.  Nays, none.

 

Water Pipe & Fittings Bid

Councilmember Newton moved to approve the purchase of water pipe and fittings from Water and Sewer Supply in the amount of $90,302.76; seconded by Councilmember Cupelli.  The motion carried by the following vote:  Mayor Rowe, aye; Mayor Pro Tem Crist, aye; Councilmember Cupelli, aye; Councilmember Newton, aye.  Nays, none.

 

Water Treatment Chemicals Bid

Mayor Pro Tem Crist moved to approve the purchase of water treatment chemicals from Mississippi Lime, Brentag Chemical, General Chemical, G.S. Robins and Univar; seconded by Councilmember Cupelli.  The motion carried by the following vote:  Mayor Rowe, aye; Mayor Pro Tem Crist, aye; Councilmember Cupelli, aye; Councilmember Newton, aye.  Nays, none.

 

Liquor License – Pungo Jungo, dba Travelers Square

Mayor Pro Tem Crist moved to approve a change of ownership liquor license to Pungo Jungo, Inc. dba Travelers Square, formerly known as Travelers Inn; seconded by Councilmember Newton.  The motion carried by the following vote:  Mayor Rowe, aye; Mayor Pro Tem Crist, aye; Councilmember Cupelli, aye; Councilmember Newton, aye.  Nays, none.

 

Second Reading

BILL NO. 2006-06                                                                               ORDINANCE NO. 11746                    

 

AN ORDINANCE REZONING REAL ESTATE DESCRIBED HEREIN FROM DISTRICT R-3, MULTI-FAMILY RESIDENTIAL, TO DISTRICT C-1P, LOCAL BUSINESS PLANNED, AND CHANGING THE ZONING DISTRICT MAP ACCORDINGLY.

 

WHEREAS, Steve and Tiara Byrn, hereinafter referred to as the Petitioner, are the owners of the following described real estate, situated in Kirksville, Adair County, Missouri, to-wit:

 

Beginning at a point 60 feet West and 21 inches North of the Northwest corner of
Block 3 of Rice’s Addition to the City of Kirksville thence West 236 feet, thence
North 185 feet, thence East 236 feet, thence South 180 feet to the place of beginning.

 

WHEREAS, Petitioner has petitioned for the rezoning of the above described real estate from District R-3 under Article IX, Section’s 25-56-57 of the City of Kirksville, Missouri, to District C-1P under Article XVIII, Section 25-90-94 of said Code, and changing of the “zoning district map” as set forth under Article I of Section 25-6 of said Code in accordance therewith; and

 

WHEREAS, the owner has submitted a development plan, and the development of the

property shall be in complete accord with the development plan which was approved by

the Planning and Zoning Commission.

 

WHEREAS, the aforesaid petition and development plan was duly referred to the Planning and Zoning Commission of the City of Kirksville, Missouri, for hearing, report and recommendation and it is the finding of this Council that a hearing was held by said Planning and Zoning Commission on February 8, 2006, and after hearing thereon it is the recommendation of said Commission to this Council that the rezoning sought in the preceding paragraph be allowed; and

 

WHEREAS, after due hearing herein, it is the finding of this Council that the greatest benefit can be derived for the City of Kirksville and the inhabitants thereof by granting of the above stated Petition to rezone and that the rezoning sought herein would not be detrimental or hazardous to the adjoining property owners or the inhabitants of the City of Kirksville, Missouri, as a whole but would in fact, enhance the orderly development of said property; and

 

WHEREAS, it is the finding of this Council that all requirements of the Code of the City of Kirksville for the rezoning of the above described real estate from District R-3 to district C-1P have been met by Petitioners;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, MISSOURI, AS FOLLOWS:

 

That the real estate described herein be and the same is hereby rezoned from District R-3 under Article IX Section 25-56-57 of the Code of the City of Kirksville, Missouri, to District C-1P, as set forth under Article XVIII Section 25-90-94 of said Code, and that the “zoning district map” as set forth under Article I of Chapter 25-6 of said Code be changed accordingly.

 

Councilmember Cupelli moved to adopt Bill No. 2006-06 on second reading; seconded by Mayor Pro Tem Crist.  The motion carried by the following vote:  Mayor Rowe – aye; Mayor Pro Tem Crist – aye; Councilmember Cupelli – aye; Councilmember Newton – aye.  Nays, none.
