The City Council of the City of Kirksville, Missouri, met in a Regular Session on Wednesday, February 7, 2007, at 5:30 p.m. in the City Hall Council Chambers.
INVOCATION/PLEDGE
Reverend Aaron Rodgerson, of the Southside Baptist Church, gave the Invocation.
Boy Scout Troop 404 led the Pledge of Allegiance.
MINUTES
Councilmember Newton moved to approve the minutes of the regular session of January 17, 2007; seconded by Councilmember McCord. The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.
ORDER OF AGENDA
City Manager Macomber asked the Council if they would consider approving bid items B through H by making one motion, instead of separate motions. Councilmember Blesz moved to consider agenda items B through H by one motion; seconded by Councilmember Crist. The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.

ACTION PRESENTATIONS
BILL NO. 2007-06
AN ORDINANCE AMENDING ORDINANCE NO. 11785 (WHICH AMENDED CHAPTER 6 OF THE KIRKSVILLE CITY CODE) BY INSERTING AN EFFECTIVE DATE OF SEPTEMBER 1, 2007 FOR THE PLACEMENT OF CARBON MONOXIDE ALARMS
Councilmember Crist moved to adopt Bill No. 2007-06 on first reading; seconded by Councilmember Newton.
Code Administrator Paul Frazier explained that Ordinance No. 11785, which was approved by the Council at their last meeting in January, did not contain the effective date of September 1, 2007, for the placement of carbon monoxide alarms. Therefore, an amendment to the ordinance is necessary.
The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.
Items B - H
Councilmember McCord moved to approve agenda items B through H, as recommended by staff; seconded by Councilmember Crist.
Addendum Q - Agreement with George Butler Associates – John Buckwalter reported an amendment to the current agreement with George Butler Associates is necessary for additional services for Basin C collection system evaluation and design, referenced as Addendum Q, for a fee not to exceed $290,000.
Osteopathy Street Agreement with W.L. Miller Company – John Buckwalter reported W.L. Miller is the low bidder for new curb and gutter, improved storm drainage, roadway realignment and asphalting and reconstruction work on Osteopathy Street. This work is pending MoDOT’s approval.
Fire Hydrants, Extensions, Valves – John Buckwalter reported this is an annual purchase, and recommending the low bidder Midwest Meter of Edinburg, Illinois at $42,192.80.
Grease, Oil, Antifreeze – Mr. Buckwalter reported that MFA Oil Company bid within the 2.5% local preference, and is recommended at $9,348.30 versus the low bid of $9,128.21.
Sodium Chlorite – Mr. Buckwalter recommended a bid from Siemens Water Technology at 80 cents per pound. This bid includes installation of a new two-part generator and continued maintenance. Three bids were received, but only this one met the specifications for the generator.
Water Pipe, Valves, Fittings – Mr. Buckwalter recommended a bid from Water and Sewer Supply of Columbia for a total of $206,164.44.
Lime – Mr. Buckwalter explained that lime was bid with the other water treatment chemicals in January, but the bid did not meet specifications. This item was re-bid, and Mississippi Lime is the recommended low bidder.

BILL NO. 2007-07
AN ORDINANCE OF THE CITY OF KIRKSVILLE, MISSOURI, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT BETWEEN THE CITY OF KIRKSVILLE AND THE MISSOURI HIGHWAYS AND TRANSPORTAION COMMISSION FOR TRANSPORTATION ENHANCEMENT FUNDS.
Councilmember Crist moved to adopt Bill No. 2007-07 on first reading; seconded by Councilmember Newton.
City Manager Macomber reported that the Council had approved this contract by motion last November, but MoDOT requires a more formal process, an Ordinance, be approved, The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.
Second Reading
BILL NO. 2007-06 ORDINANCE NO. 11786
AN ORDINANCE AMENDING ORDINANCE NO. 11785 (WHICH AMENDED CHAPTER 6 OF THE KIRKSVILLE CITY CODE) BY INSERTING AN EFFECTIVE DATE OF SEPTEMBER 1, 2007 FOR THE PLACEMENT OF CARBON MONOXIDE ALARMS.
WHEREAS, the Kirksville City Council adopted Ordinance No. 11785 at their regular meeting of January 17, 2007, regarding the placement and requirements of carbon monoxide alarms in residential dwellings and buildings within the city limits of Kirksville; and
WHEREAS, the city staff had reported that the effective date of Ordinance No. 11785 would be September 1, 2007, but this date was not included within the Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, MISSOURI, AS FOLLOWS:
Section 1. Ordinance No. 11785, Section 2, is hereby amended as follows:
Section 2. This ordinance shall
become effective following passage by the City Council and signing by the
Mayor. on September 1, 2007.
Section 2. Ordinance No. 11785 is also amended to include subparagraph (11) as follows:
Carbon Monoxide Alarm devices; requirements.
(11) Effective Date. This Ordinance will become effective on September 1, 2007.
Section 3. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the City of Kirksville, Missouri, as an addition or amendments thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
BILL NO. 2007-07 ORDINANCE NO. 11787
AN ORDINANCE OF THE CITY OF KIRKSVILLE, MISSOURI, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT BETWEEN THE CITY OF KIRKSVILLE AND THE MISSOURI HIGHWAYS AND TRANSPORTAION COMMISSION FOR TRANSPORTATION ENHANCEMENT FUNDS.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, MISSOURI, AS FOLLOWS:
SECTION 1:
That the City Manager is hereby authorized to execute, on behalf of the City of Kirksville, a contract with the Missouri Highways and Transportation Commission providing for funds for transportation enhancement activities.
SECTION 2:
That all ordinances or parts of ordinances therefore enacted which are in conflict herewith are hereby repealed.
SECTION 3:
This ordinance shall be in full force and effect from and after the date of its passage and approval.
Councilmember Newton moved to adopt Bill No. 2007-06 and 2007-07 on second reading; seconded by Councilmember Blesz. The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.
Council Comments
Councilmember McCord thanked the city departments for their services during the cold temperatures.
ADJOURNMENT
There being no further business to come before the Council, Councilmember Crist moved to adjourn to an executive session to consider litigation, RsMO 610.021(1) and personnel RsMO 610.021(3); seconded by Councilmember Newton. The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - aye; Crist - aye; McCord - aye; Blesz - aye. Nays - none.
Mayor Rowe adjourned the meeting at 5:55 p.m.
