The City Council of the City of Kirksville, Missouri, met in a Regular Session on Monday,                                            March 19, 2007, at 5:30 p.m. in the City Hall Council Chambers.  (Due to the rezoning request, the regular Wednesday meeting date was moved up to Monday, March 19.)

MINUTES

Councilmember McCord moved to approve the minutes of the regular session of March 7, 2007; seconded by Councilmember Blesz.  The motion carried by the following vote:  Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.

ACTION PRESENTATIONS

BILL NO. 2007-10                                                                                      

AN ORDINANCE REZONING REAL ESTATE IN THE 600 BLOCK OF SOUTH JAMISON STREET, FOX RUN,  DESCRIBED HEREIN, FROM DISTRICT LOW DENSITY CORRIDOR, TO DISTRICT RP-3, MULTI-FAMILY RESIDENTIAL DISTRICT PLANNED, AND CHANGING THE ZONING DISTRICT MAP ACCORDINGLY.

 

Councilmember Blesz moved to adopt Bill No. 2007-10 on first reading; seconded by Councilmember Crist.

 

Code Administrator Paul Frazier reported the owners of the property intend to construct four duplexes, condominium style, on the west side of Jamison, north of the Frick and Cundiff law offices.  The Planning and Zoning Commission unanimously approved the rezoning request, subject to the developers submitting a storm water management plan prior to final grading of the project.

 

The motion carried by the following vote:  Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.

 

Airport Runway Repairs Bid

Councilmember Crist moved to authorize the City Manager to enter an agreement with Maxwell Asphalt of Littleton, Colorado for airport runway repairs; seconded by Councilmember McCord.

 

John Buckwalter, Public Works Director, reported the project will consist of improvements to the main runway, and removal and reapplication of pavement markings.  Maxwell was the low bidder for the project.

 

The motion carried by the following vote:  Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.

 

Forest Lake Use for Bass Tournaments

Councilmember Crist moved to approve the use of Forest Lake for bass fishing tournaments on April 1, May 26, June 16, August 11 and September 1, 2007; seconded by Councilmember Blesz.  The motion carried by the following vote:  Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.

City Manager Macomber asked that a second reading of Bill No. 2007-10 be considered by the Council.  Councilmember Crist moved to add the second reading to the agenda; seconded by Councilmember McCord.  The motion carried by the following vote:  Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.

BILL NO. 2007-10                                                                                       ORDINANCE NO. 11790

AN ORDINANCE REZONING REAL ESTATE IN THE 600 BLOCK OF SOUTH JAMISON STREET, FOX RUN,  DESCRIBED HEREIN, FROM DISTRICT LOW DENSITY CORRIDOR, TO DISTRICT RP-3, MULTI-FAMILY RESIDENTIAL DISTRICT PLANNED, AND CHANGING THE ZONING DISTRICT MAP ACCORDINGLY.

 

            WHEREAS, Kenneth L. Read, Debra A. Read, Dustin C. Read, Adam P. Read, and Benjamin H. Hickman, hereinafter referred to as the Petitioner, are the owners of the following described real estate, situated in Kirksville, Adair County, Missouri, to wit:

 

            Lots 2 and 3 Fox Run Plat 3 addition to the City of Kirksville, MO.

 

            WHEREAS, Petitioners have petitioned for the rezoning of the above described real estate from Low Density Corridor Zone under Article XXIII, Section 25-114 zoning code of the City of Kirksville, Missouri, to District RP-3 under Article I, Section 25-5 of said Code, and changing of the “zoning district map” as set forth under Article I of Section 25.6 of said Code in accordance therewith; and

 

            WHEREAS, the Petitioner has submitted a site development plan as required under Chapter 25-121 which said plan has been conditionally approved by the City of Kirksville Planning and Zoning Commission, and shall be a part of the rezoning of said development; and

 

            WHEREAS, the developers may proceed with the construction of this project after a site storm drainage plan has been submitted by the developers and approved by the City Engineer; and

 

            WHEREAS, the aforesaid petition, with the aforementioned site development plan, was duly referred to the Planning and Zoning Commission of the City of Kirksville, Missouri, for hearing, report and recommendation and is the finding of this Council that a hearing was held by said Planning and Zoning Commission on March 14, 2007, and after a hearing thereon it is the recommendation of said Commission to this Council that the rezoning sought in the preceding paragraph be allowed; and

 

            WHEREAS, after due hearing herein, it is the finding of this Council that the greatest benefit can be derived for the City of Kirksville and the inhabitants thereof by granting of the above stated Petition to rezone and that the rezoning sought herein would not be detrimental or hazardous to the adjoining property owners or the inhabitants of the City of Kirksville, Missouri, as a whole, but would in fact, enhance the orderly development of said property; and

 

            WHEREAS, it is the finding of this Council that all requirements of the Code of the City of Kirksville for the rezoning of the above described real estate  from Low Density Corridor Zone to District RP-3 have been met by Petitioners;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, MISSOURI, AS FOLLOWS:

 

            That the real estate described herein is hereby rezoned from Low Density Corridor Zone under Article XXIII of the Code of the City of Kirksville, Missouri, to District RP-3, as set forth under Article I, Section 25-5 of said Code, and that the “zoning district map” as set forth under Article I of Chapter 25-6 of said Code be changed accordingly.

 

Councilmember Crist moved to adopt Bill No. 2007-10 on second reading; seconded by Councilmember Blesz.  The motion carried by the following vote: Mayor Rowe - aye; Councilmembers: Newton - absent; Crist - aye; McCord - aye; Blesz - aye.  Nays – none.
