The City Council of the City of Kirksville, Missouri, met in a Regular Session on Tuesday, May 15, 2007, at 5:30 p.m. in the City Hall Council Chambers.
INVOCATION/PLEDGE
There was no representation of the scheduled Invocation speaker, and therefore no invocation was given.
Boy Scout Troop 401 led the Pledge of Allegiance.
MINUTES
Councilmember Rodgerson moved to approve the minutes of the regular session of May 1, 2007; seconded by Councilmember McCord. The motion carried by the following vote: Mayor Newton - aye; Councilmembers: Mayer - aye; McCord - aye; Rodgerson aye; Rowe - aye. Nays none.
ORDER OF AGENDA
Councilmember Rowe moved to approve the order of the agenda; seconded by Councilmember Mayer.
Mayor Newton asked that Item 1 under Action Presentations Amending the Smoking Ban Ordinance - be removed from the agenda to allow the City Council to discuss additional amendments at a Study Session next Tuesday, May 22.
City Manager Macomber reported that letters will be mailed to the not-for-profit businesses advising them of the City Councils interest to include them in the Smoking Ban. The Council can discuss this further at their Study Session on May 22.
Councilmember Rodgerson moved to approve the amendment to the agenda; seconded by Councilmember Mayer. The motion carried by the following vote: Mayor Newton - aye; Councilmembers: Mayer - aye; McCord - aye; Rodgerson aye; Rowe - aye. Nays none.

INFORMATION PRESENTATION
Mayor Newton read and presented a Proclamation recognizing National Public Works Week, National Police Week and celebrating the 25th anniversary of the Chariton Valley Association.
CITIZEN PARTICIPATION
Brenda Sewell, Highway 3, Kirksville, approached the Council with a request to include private not-for-profit membership clubs. She also asked how they are to keep an eye on someone who might light up in the restroom, or immediately outside of her business? The Council addressed her question
ACTION PRESENTATIONS
Bid - Tree Limb and Brush Grinding
Councilmember Rodgerson moved to approve a bid from Damon Pursell Company, located in Liberty, Missouri for tree limb and brush grinding; seconded by Councilmember Rowe.
John Buckwalter reported that the city has contracted with Damon Pursell Company for the past several years for the grinding of tree limbs and brush into wood chips. The budgeted amount is not to exceed $12,000; last years work was done for $10,000, but the mobilization charge has increased from $800 to $1,000.
The motion carried by the following vote: Mayor Newton - aye; Councilmembers: Mayer - aye; McCord - aye; Rodgerson aye; Rowe - aye. Nays none.
Committee/Board Appointments
City Manager Macomber asked the Council to also consider the appointment of Carolyn Christman as the KBSA representative to fill an unexpired term, vacated by John Witt, on the Planning and Zoning Commission.
Councilmember McCord moved to reappoint Glen Novinger and Randy Hagerty to another four-year term on the Planning and Zoning Commission; appoint Carolyn Christman to fill the unexpired term on the Planning and Zoning Commission; re-appoint Bob Ehrlich to another five-year term on the Board of Adjustment; re-appoint Doyle Dover to a five year term as Alternate on the Board of Adjustment; and appoint Kim Easley to an unexpired term, vacated by Elaine Scudder, on the Lakes, Parks and Recreation Commission. the motion was seconded by Councilmember Rowe. The motion carried by the following vote: Mayor Newton - aye; Councilmembers: Mayer - aye; McCord - aye; Rodgerson aye; Rowe - aye. Nays none.
Council Comments:
City Manager Macomber announced the National Peace Officers Candlelight vigil at 7:00 p.m. this evening at the Courthouse. The KBSA opening ceremonies will be this Saturday, May 19, at 10:30 a.m. at the North Park Black Field. Public Works will be recognizing Public Works Week on Friday, May 25, with a noon barbecue, and a presentation will be made to Kathy Hurst, widow of former employee Steve Hurst.

Councilmember Rodgerson moved to adjourn; seconded by Councilmember Mayer. The motion carried by the following vote: Mayor Newton - aye; Councilmembers: Mayer - aye; McCord - aye; Rodgerson aye; Rowe - aye. Nays none.
Mayor Newton adjourned the meeting at 6:00 p.m.
