The City Council of the City of Kirksville, Missouri, met in a Regular Session on Monday, June 2, 2008, at 5:30 p.m. in the City Hall Council Chambers.

 

INVOCATION/PLEDGE

Reverend Jim Robinson of the First United Methodist Church, gave the Invocation.  The Mayor and Council led the Pledge of Allegiance.

BILL NO. 2008-21                                                                           RESOLUTION NO. R6-2-563

A RESOLUTION RECOGNIZING FRED HOUSMAN, UTLITY OPERATOR, UPON HIS RETIREMENT FOR  23 YEARS AND 10  MONTHS OF SERVICE TO THE CITY OF KIRKSVILLE, MISSOURI.

 

WHEREAS, the City of Kirksville is desirous of recognizing long-term employees; and

 

WHEREAS,  Fred Housman has worked for the City of Kirksville  Public Works Department since August 12, 1984; and

 

WHEREAS, Fred Housman was hired as  Street Maintenance Worker, and was promoted on March 19, 1989 to Equipment Operator in the Street Division; and

 

WHEREAS, Fred Housman was again promoted on January 11, 1998 to Utility Operator in the Wastewater Treatment Division; and

 

WHEREAS,   Fred Housman is retiring on June 5, 2008, after serving the City of Kirksville and its citizens for 23 years and 10 months.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council extends respect and appreciation on behalf of a grateful City to Fred Housman for his years of service.

 

Passed by the City Council and signed by the Mayor this 2nd day of June 2008.

 

 

Mayor Rowe read the Resolution in its entirety, and will present the Resolution to Fred at a going-away get together this Thursday.

BILL NO. 2008-22                                                                           ORDINANCE  NO.  11837

AN ORDINANCE OF THE CITY OF KIRKSVILLE, MISSOURI VACATING A PORTION OF THE EAST-WEST ALLEY IN BLOCK 1, COSBY ADDITION TO CITY OF KIRKSVILLE 

 

Councilmember McCord moved to adopt Bill No. 2008-22 on first reading; seconded by Council member Detweiler.

 

John Buckwalter reported the owner wishes to construct a garage on this property, although not on the former alley property.  The alley is undeveloped.  The combining of the lots will provide space for the structure.  The City will retain the easement over the dedicated portion to allow for access to maintain the sewer.

 

The motion carried by the following vote:  Mayor Rowe, aye; Council members: Detweiler – aye; Kuhns – aye; McCord – aye; Rodgerson – aye.  Nays - 0.

 

BILL NO. 2008-23                                                                           ORDINANCE NO. 11838 

AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF THE CITY OF KIRKSVILLE, MISSOURI REGULATING THE WEIGHT LIMITS OF MOTOR VEHICLES.

 

Council member Rodgerson moved to adopt Bill No. 2008-23 on first reading; seconded by Council member Kuhns.

 

Jim Hughes reported this is a housing construction area.  There are weight limit signs in this area, but the City Code was not amended.  Weight limits were adopted to prevent damage to the road, and to provide safety for the trucks.    Shepherd Avenue from Halliburton west to the city limits is a narrow asphalt street with open ditches and severe shoulder dropoff.

Multi-Aero/Air Choice One Airport Terminal Lease Agreement

Council member McCord moved to authorize the City Manager to enter into a lease agreement with Multi-Aero, Inc./Air Choice One for the airline office space in the Kirksville Regional Airport Terminal building; seconded by Council member Detweiler.

 

Mari Macomber reported that Multi Aero will provide limited services beginning July 1.  Mesa will need to vacate the premises prior to then.  The Department of Transportation says Mesa needs to run until June 30.

Council Policy 15 Amended – Airport Billing & Collection

Council member Rodgerson moved to approve a revision to Council Policy 15 Airport Billing and Collection; seconded by Council member Kuhns.

 

Mari Macomber explained that the amendment allows for negotiations on fuel discounts.

Bid – Flat Bed ¾ ton Truck

Council member Rodgerson moved to approve the bid of Advantage Auto Center of Macon for a 2008 ¾ ton truck with flat bed for a net cost of $31,375.40; seconded by Council member McCord. 

 

John Buckwalter explained this truck will replace a 1996 Ford two-wheel drive used for the Street and Parks Maintenance.  Bids were opened on May 20 from three dealers.  Advantage bid a truck at $30,462.19, and they notified the city the next day that the truck had been sold and was no longer available.  A similar truck at a slightly higher price was offered with options over the specifications.  The truck is available in Macon and the price is still under the budget amount, and is less than the local preference.  If bids are withdrawn, and wait until August to re-bid, it will cost the City $3,000 to $4,000 more.

 

City Manager Macomber said that bidding this time of the year needs to be avoided due to the non-availability of trucks.

Liquor License Renewals

Council member Detweiler moved to approve the renewal of liquor licenses for merchants holding said licenses for the annual period commencing July 1, 2008; seconded by  Council member Kuhns.

 

Laura Guy reported a total of 12 renewals have been received to date, with the remainder to be considered at the June 16th Council meeting.

 

The motion carried by the following vote:  Mayor Rowe, aye; Council members: Detweiler – aye; Kuhns – aye; McCord – aye; Rodgerson – nay.  Ayes – 4; Nays - 1.

 

Street Use – Red, White & Blue Parade

Council member Detweiler moved to approve a request for the use of City streets for the All American Red, White & Blue Parade on July 4, 2008; seconded by Council member Rodgerson.  The motion carried by the following vote:  Mayor Rowe, aye; Council members: Detweiler – aye; Kuhns – aye; McCord – aye; Rodgerson – aye.  Nays - 0.

 

 

Second Reading

BILL NO. 2008-22                                                                           ORDINANCE  NO.  11837

AN ORDINANCE OF THE CITY OF KIRKSVILLE, MISSOURI VACATING A PORTION OF THE EAST-WEST ALLEY IN BLOCK 1, COSBY ADDITION TO CITY OF KIRKSVILLE 

 

WHEREAS, the adjoining property owners have requested the vacation of the following alley:

 

That portion of an 18 foot wide east/west alley between Cottonwood Street and Hickory Street from Luther Street on the west, east 165 feet, to the east line of Lots 7 and 12 in Block 1, Cosby Addition, to the City of Kirksville, and located in the SW ¼ of Section 4, T 62 N, R 15 W, City of Kirksville, Adair County, Missouri.

 

WHEREAS, the vacation of said alley would not be detrimental to the best interests of the citizens of the City of Kirksville, Missouri.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF KIRKSVILLE, MISSOURI AS FOLLOWS:

 

Section 1.  The alley described above is hereby vacated.

 

Section 2.  The City of Kirksville, Missouri hereby retains easements over, along, across and upon that portion of the alley vacated above for maintenance, repair, improvement, construction, reconstruction, replacement or relocation of all manner of public utilities, whether by the City, its agents or contractors, or franchisees.  The easement retained herein shall be free from any and all buildings, structures or other obstructions.

 

Section 3.  This ordinance shall be in full force and effect from and after the date of its passage.

 

 

BILL NO. 2008-23                                                                           ORDINANCE NO. 11838 

AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF THE CITY OF KIRKSVILLE, MISSOURI REGULATING THE WEIGHT LIMITS OF MOTOR VEHICLES.

 

WHEREAS, a citizen request for a review of the weight limits on Shepherd Avenue, near the new housing construction, resulted in a review of the history/restrictions of such use, following the 1997 annexation, and the associated written code contained in section 15-430; and  

 

WHEREAS, a section of  Shepherd  Avenue from Halliburton west to the city limits is a narrow asphalt street, with open ditches and severe shoulder drop off.  This section was a gravel road when it was transferred from the County to the City.  The City overlaid the street with hot mix asphalt, but no widening was constructed.  It is subject to rutting and edge damage from heavily loaded vehicles; and

 

WHEREAS, the inclusion of a tonnage weight limit on this section of  Shepherd Avenue should remedy the problem of damaging this portion of the street.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF KIRKSVILLE, MISSOURI AS FOLLOWS:

 

Section I.  Chapter 15, Section-430 of the code, pertaining to 15 ton weight limits, is amended as follows:

 

Add:  Shepherd Avenue, from the west right of way limit of Halliburton Street to the west city limit.

 

Section II.  Effective Date

 

The modifications to this ordinance shall be effective from and after its date of passage.

 

Section III.  Incorporation into the City of Kirksville Code of Ordinances

 

The provisions of this ordinance shall be included and incorporated in the Code of         Ordinances of the City of Kirksville, Missouri as an addition or amendment thereto.
