The City Council of the City of Kirksville, Missouri, met in a Regular Session on Tuesday, July 17, 2007, at 5:30 p.m. in the City Hall Council Chambers.
INVOCATION/PLEDGE
Councilmember (Reverend) Aaron Rodgerson gave the Invocation.
The Mayor and City Council led the Pledge of Allegiance.
MINUTES
Councilmember Rodgerson moved to approve the minutes of the regular session of July 3, 2007; seconded by Councilmember Mayer. The motion carried by the following vote: Mayor Pro Tem Rowe aye; Councilmembers: Mayer - aye; Rodgerson aye. Mayor Newton - absent; Councilmember McCord absent. Nays none.

INFORMATION PRESENTATION

CITIZEN PARTICIPATION
Charles Morris, owner of Morris Oil Company, addressed the Council that his company has supplied fuel at the Kirksville airport for over ten years. He got behind on paying his bill with the city at the beginning of this year, after spending more money than planned on upgrading the warehouse. He has paid over $100,000 to the city since the first of the year, and would like the Council to consider keeping Morris Oil as the fuel supplier.

BILL NO. 2007-29
AN ORDINANCE DE-ANNEXING A CERTAIN AREA, KNOWN AS REAL ESTATE LISTED IN ONE TRACT THAT LAYS WITHIN THE CURRENT CITY LIMITS OF KIRKSVILLE, MISSOURI.
Councilmember Mayer moved to adopt Bill No. 2007-29 on first reading; seconded by Councilmember Rodgerson.
Brad Selby explained the property is currently addressed as 4101 South Baltimore, on the southeast edge of the city. It was part of the 2001 annexation, and was included in the plan to deliver water service. The water was connected to all properties except this location due to the high cost. Mr. Jones petitioned for de-annexation, and a public hearing was held on June 19, with no opposition. City staff recommends de-annexation.

BILL NO. 2007-30 RESOLUTION NO. R7-17-549
A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT THE FINAL APPLICATION FOR THE 2007 MISSOURI LAND AND WATER CONSERVATION FUND GRANT TO THE NATIONAL PARK SERVICE.
WHEREAS, the City of Kirksville is an expanding city in the growing county of Adair, and
WHEREAS, the City deems it necessary to improve a public park to serve its citizens as well as the traveling public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, as follows:
1. That the City was notified that our 2007 Land and Water Conservation Fund (LWCF) Grant that will fund a skate park in the North Park Complex was recommended to the National Park Service for approval.
2. The City Manager is hereby authorized to sign and execute the necessary documents for forwarding the final application to the National Park Service. The City Manager and Mayor are also hereby authorized to sign the project agreement, subsequent amendments, and other necessary documents between the City of Kirksville and the State of Missouri.
3. Once the final award is made, the City of Kirksville accepts all responsibilities under the Land & Water Conservation Fund regulations. This includes, but is not limited to, project site to be protected by the LWCF rules and regulations in perpetuity, maintenance of the park for public outdoor recreation purposes, compliance with the provisions of Title VI of the Civil Rights Act of 1964, underground wiring of all telephone and electrical wires under 15 KV within the park both under this project and in the future, provisions of facilities which are accessible to and usable by people with special needs.
Councilmember Mayer moved to approve Bill No. 2007-30; seconded by Councilmember Rodgerson.
Kris McKim reported the funds will be used to build a skate park in the North Park Complex. The grant was applied for in 2006, and in June of 2007, notification was received that the project had been recommended for approval. Another resolution is required to complete the additional paperwork. The city will contribute $10,000 in-kind services; the local skateboarders group committed $40,000; and the grant will be for $30,000.

Kris McKim also reported that notification has been received from the Missouri Department of Transportation that enhancement grant funding was approved to complete some sidewalks.
KRXL Car Show Street Use
Councilmember Rodgerson moved to approve street use on the downtown square for the KRXL Car Show on August 4; seconded by Councilmember Mayer.
Tim King reported this is an annual event. The Farmers Market will use the north courthouse parking lot during this event. There was no request for the use of the theater parking lot this year.

Second Reading
BILL NO. 2007-29 ORDINANCE NO. 11803
AN ORDINANCE DE-ANNEXING A CERTAIN AREA, KNOWN AS REAL ESTATE LISTED IN ONE TRACT THAT LAYS WITHIN THE CURRENT CITY LIMITS OF KIRKSVILLE, MISSOURI.
WHEREAS, a verified petition signed by the owners of the real estate hereinafter described requesting de-annexation of said area from the City of Kirksville, Missouri, was previously filed with the City of Kirksville; and
WHEREAS, said real estate is located within the present City limits of the City of Kirksville, Missouri; and
WHEREAS, in accordance with RsMO. 71.012, a public hearing concerning said matter was held at the City Hall, in Kirksville, Missouri, at the hour of 5:30 p.m., on Tuesday, June 19, 2007; and
WHEREAS, notice of-said public hearing was given by publication of notice thereof in the Kirksville Daily Express, a daily newspaper of general circulation in Adair County, Missouri; and
WHEREAS, at said public hearing, all interested persons, corporations or political subdivisions were afforded the opportunity to present evidence regarding the proposed de-annexation; and
WHEREAS, no written objection to the proposed de-annexation was filed with the City Council of Kirksville, Missouri within fourteen days after the public hearing by at least two percent of 'the qualified voters of the city, or two qualified voters of the area sought to be de-annexed; and
WHEREAS, the City Council of Kirksville, Missouri does hereby find and determine that said de-annexation is reasonable due to the property owners not receiving water lines to the dwelling property line as described in the Citys Plan of Intent of July 2000; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KIRKSVILLE, MISSOURI, AS FOLLOWS:
Section 1. That a portion of real estate be de-annexed, more particularly described as follows:
A part of the South half of the Southeast Quarter of the Southwest Fourth of Section 22, Township 62, Range 15, being more particularly described as follows: Beginning at the Southwest corner of said tract of land, thence North 162 feet, thence East 169 feet, thence South 162 feet, thence West 169 feet to the place of beginning.
Section 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed insofar as they do conflict.
Section 3. This ordinance shall be of full force and effect from and after the date of its passage.
Councilmember Rodgerson moved to adopt Bill No. 2007-29 on second reading; seconded by Councilmember Mayer. The motion carried with the following vote: Mayor Pro Tem Rowe aye; Councilmembers: Mayer - aye; Rodgerson aye. Mayor Newton - absent; Councilmember McCord absent. Nays none.
Council Comments
Mayor Pro Tem Rowe announced the next Council Study Session scheduled for July 24 will be held on July 31 at 5:30 p.m.
