The City Council of the City of Kirksville, Missouri, met in a Regular Session on Monday, July 7, 2008, at 5:30 p.m. in the City Hall Council Chambers.
INVOCATION/PLEDGE
Pastor Jeff Overturf, of the First Church of God, gave the Invocation. The Mayor and Council led the Pledge of Allegiance.
MINUTES
City Manager Macomber stated that a change in the wording under Comments (last sentence) of the June 16 minutes was made from No plans for Route P at this time, to Route P was not part of the public hearing. Council member Rodgerson moved to approve the revised minutes of the Regular Session of June 16, and the Special Session minutes of June 19, 2008; seconded by Council member Kuhns. The motion carried by the following vote: Mayor Rowe, aye; Council members: Detweiler aye; Kuhns aye; McCord absent; Rodgerson aye. Ayes 4; Nays 0; Absent - 1.
Council member McCord entered the meeting at 5:34 p.m.
ORDER OF AGENDA
City Manager Macomber explained that if the Council wishes to take action on the variance request, the subject matter of the public hearing, the Council may add it to the agenda.
Council member Rodgerson moved to approve the order of the agenda; seconded by Council member Detweiler. The motion carried by the following vote: Mayor Rowe, aye; Council members: Detweiler aye; Kuhns aye; McCord aye; Rodgerson aye. Nays - 0.
INFORMATION PRESENTATION
Mayor Rowe opened the public hearing at 5:35 p.m. regarding a variance to the Sign Code request from the First Church of God.
Code Administrator Brad Selby reported a sign was installed on the property of 2900 South Halliburton for the First Church of God which exceeds the Sign Code for a R-3 multi-family zoning district. The Sign Code does not allow the Board of Adjustment to hear requests for variance in height and size of signs. Therefore the Council is asked to consider a variance to allow the sign to remain at this location. City staff supports approval of the variance.
Pastor Jeff Overturf, 2904 South Halliburton, said there was a mistake made when ordering the sign, and asked the Council to approve their request.
James Rasura, 516 E. Jefferson, asked Pastor Overturf to come to the podium and explain the motive of the sign.
There being no further comments, Mayor Rowe closed the public hearing at 5:40 p.m.
Council member Rodgerson moved to add the sign variance request to the agenda as Item No. 4; seconded by Council member McCord. The motion carried by the following vote: Mayor Rowe, aye; Council members: Detweiler aye; Kuhns aye; McCord aye; Rodgerson aye. Nays - 0.

ACTION PRESENTATIONS
BILL NO. 2008-28 RESOLUTION NO. R7-7-566
A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT ALLOWING FOR THE TRANSFER OF CITY LAND, ADJOINING BUSINESS ROUTE 63, TO FIRST ASSEMBLY OF GOD CHURCH, FOR EXPANSION OF THEIR PROPERTY.
WHEREAS, First Assembly of God Church has requested the transfer of City-owned land, adjoining Business Route 63, which is adjacent to their church property, and
WHEREAS, channel improvements and repairs were performed by Dwayne Pratte, and the sanitary sewer was elevated next to Bear Creek in exchange for the transfer of land, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Kirksville, Missouri, hereby authorizes the execution of an agreement with First Assembly of God Church to allow for the transfer of city-owned land to First Assembly of God Church in exchange for these channel improvements and repairs, plus elevating the sanitary sewer along Bear Creek, of which all repairs and improvements have been completed.
Council member Kuhns moved to approve Bill No. 2008-28; seconded by Council member Detweiler.
Code Administrator Brad Selby reported that in 1999, Dwayne Pratte requested the vacation of a portion of City-owned right-of-way on the west side of the 2100 block of South Franklin. The City Council approved a resolution authorizing an agreement to execute a quit claim deed to Mr. Pratte for the land. The Quit Claim Deed was never recorded by the Prattes, therefore the land remains city property. Mrs. Pratte (Dwayne now deceased) has sold the land to the First Assembly of God Church, and wishes the property deeded to the Church as originally agreed to. Mr. Selby explained that a new deed has been prepared which will quit claim the property to the Church.
Reverend Robert Fredricks, 614 East Randolph, of the First Assembly of God Church, said this allows for an acre and one-half of property addition to the Churchs property which will make it more accessible. They are in the process of determining the possibility of putting in a bridge.

Forest-Llewellyn Cemetery Lot Price Increase
Council member McCord moved to increase the purchase price of burial spaces in the Forest-Llewellyn Cemetery to $200 per space; seconded by Council member Kuhns.
Mari Macomber reported the price of the lots has not increased from the current $90 for a number of years. The $200 cost is $100 less than the local cemeteries. She told the Council that additional ideas will be presented to the Council regarding improvements to the cemetery and headstone repair.

Bid Two-wheel drive Truck for Codes
Council member Rodgerson moved to approve a bid from Lovegreen Ford for the purchase of a 2008 one-half ton truck for a cost of $15,731.77; seconded by Council member Detweiler.
John Buckwalter reported this truck will replace a 1996 Ford one-half ton pickup that was scheduled for replacement in 2006, but had been retained because of its low maintenance demands. The truck is approaching 50,000 miles. It is recommended that the low bid from Lovegreen Ford be approved to provide a truck to the Codes Department.

Variance to Sign Code for First Church of God
Council member Rodgerson moved to approve a variance in the Sign Code for the First Church of God; seconded by Council member Kuhns. The motion carried by the following vote: Mayor Rowe, aye; Council members: Detweiler aye; Kuhns aye; McCord aye; Rodgerson aye. Nays - 0.
Comments
Council member Kuhns announced the Library is having a Renaissance Fair this Thursday. Mayor Rowe will be out of town on July 28th and asked the Council if they wish to schedule the alcohol discussion at a meeting in August after she returns. The Council consensus was to reschedule the discussion after August 4.
Adjournment to Executive Session
Council member McCord moved to adjourn to an Executive Session regarding a Personnel Matter RsMO 610.021(3) and a Labor Negotiations Matter RsMO 610.021(9); seconded by Council member Detweiler.
